1. Scope and parties
These terms apply to all services of Mormonyra B.V., trading as Mormonyra, at Haarlemmerweg 178, 1051 CV Amsterdam (KvK 68310200, VAT NL877581083B01). Contact: 020 808 4193 and [email protected].
They apply together with each written quote. If the quote conflicts, the quote wins except where mandatory law says otherwise. Accepting a quote confirms you could read these terms via legal notice. Browsing the site or sending a message alone does not create a contract.
2. Definitions
| Term | Meaning |
|---|---|
| Client | The person or company that accepts a quote. |
| Consumer | A natural person acting outside their trade or profession. |
| Business client | A client acting in trade or profession, such as a label or producer. |
| Quote | The written document stating service, date, VAT-inclusive price, deposit and any special terms. |
| Session | The reserved studio time or agreed offline working time. |
| Service | Recording, mixing, mastering, podcast work or related studio activity as on services. |
| Deposit | 30% of the quoted amount to confirm the slot. |
| Business day | Monday to Friday, excluding public holidays in the Netherlands. |
3. Quotes and contract formation
After your enquiry we send a quote, usually within 2 business days. Quotes stay valid for 2 weeks unless stated otherwise. The contract is formed when you accept in writing (email is enough) and the deposit reaches our account. Until then the slot is not firm.
We may decline a request for a reasonable reason, such as unrealistic timing, safety concerns or missing rights in supplied material. Budget tips are in our session budget guide.
4. Pre-contract information
Before you accept, the quote states the main features of the service, total price including 21% VAT, dates or delivery times, our identity and how to complain. This reflects information duties for distance contracts. Site rates are indicative; see vocal recording or mix production for detail.
5. Prices and extras
Prices in quotes and on service pages are in euros and include 21% VAT unless a business quote says otherwise. The quote total controls. Extra hours beyond the booked block are charged only if you confirm them, at the hourly rate in the quote (for example €95 for vocal work or €88 for in-studio mixing).
Travel, parking or outside musicians are yours unless the quote includes them. We do not add hidden file fees; extra revision rounds are covered in article 10.
6. Payment and business terms
The deposit is 30% of the quoted amount and offsets the balance. Consumers usually pay the remainder on the session day or when offline work is delivered. Business clients pay within 14 days of the invoice date unless agreed otherwise.
Late payment may attract statutory commercial interest and reasonable collection costs. Until full payment we may withhold final mix or master files; raw sessions follow article 9.
7. Rescheduling, cancellation and no-shows
| Timing | Effect |
|---|---|
| More than 7 days before | Free reschedule or cancel; deposit refunded within 14 days if you cancel. |
| Within 7 days | Deposit credited once to a new date within three months; if none is booked, the deposit is forfeited. |
| Under 48 hours or no-show | Deposit remains due; we may invoice the full session if the slot cannot be reused. |
Send requests in writing to [email protected]. Force majeure is in article 14. These rules do not limit statutory withdrawal where it applies.
8. Consumer withdrawal
If you conclude a service contract at a distance (email, phone, form), you generally have 14 days to withdraw without giving reasons. The period starts on the day the contract is concluded.
If you explicitly ask us to start before the period ends (for example a session within two weeks), you pay a fair amount for work already done if you withdraw. If the service is fully performed with your prior consent and explicit waiver, the right ends once performance is complete. Bespoke audio usually falls under that exception.
Withdraw in writing via [email protected] with your name, quote reference and date. We refund within 14 days using the same payment method unless you agree otherwise.
9. Sessions, studio rules and age
Sessions take place at Haarlemmerweg 178 during Monday–Friday 09:30–18:30, Saturday by appointment. Closed on Sunday.. We work across 3 rooms, including a live room of about 42 m² and 2 iso booths. Follow engineer instructions on safety and levels; hearing protection is available.
Guests from age 16 need written consent from a parent or guardian who books and pays; under 16 only by prior agreement. No smoking or vaping on site. Damage to studio gear through intent or gross negligence is charged to the client.
10. Revisions and quality
Offline mix and mastering include 2 revision rounds as described on the relevant service pages (see mix and mastering). One round means one bundled list of notes. Further rounds or a new artistic direction after sign-off are quoted separately.
We work to professional standards in our field; we cannot guarantee a specific commercial outcome. Report technical defects in delivered files within 14 days and we will fix them at no charge.
11. Files, delivery and archive
Unless the quote says otherwise, we deliver common formats (such as 24-bit WAV) via download link or media you supply. Offline work starts once all required tracks are complete and readable; see exporting stems.
We store session files for 24 months after the last project activity, then delete them unless you arrange an extension in writing. You remain responsible for backups. Release metadata is covered in our mastering metadata guide.
12. Intellectual property
Music, lyrics and samples you supply stay yours; you warrant you have the necessary rights and indemnify us against third-party claims. We do not claim authorship of your works.
Recording and production rights on the masters follow the quote; we keep internal quality-use rights only, not marketing references without your written OK.
We do not use your recordings to train AI models and do not create voice clones without separate written consent from the performer.
13. Personal data
We process data under our privacy policy. If you supply artist or guest data as a business client, a data processing agreement may apply. The FormSubmit contact route is described in legal notice.
14. Liability
Our liability is limited to direct damage from an attributable breach, capped at the invoice for that job, except for intent, wilful recklessness or personal injury. We are not liable for missed release dates, lost profits or corruption of media you supply.
Non-contractual site information is further explained in the disclaimer.
15. Force majeure
In force majeure (power failure, epidemic, government measure or critical supplier outage) we postpone performance or may terminate without damages, refunding prepaid amounts for unperformed parts. We will inform you as soon as practicable.
16. Complaints, disputes and law
Send complaints to [email protected]; we respond within 2 business days with a proposal. If you remain unsatisfied, consumers may use the EU ODR platform (ODR) or a competent court in the Netherlands.
Dutch law governs these terms. Mandatory consumer rules in your EU home country still apply where required. We publish changes with date 14 October 2026; the version at quote acceptance applies to your job. See also FAQ.
